  • Our land use and planning team deals with all aspects of Israeli planning and zoning law.  We have extensive experience advising and representing our clients on all aspects of contentious and non-contentious zoning, land use and construction matters. Our expertise includes:

     

    • Advising our clients on how current and proposed national and local zoning plans and policies affect real estate which they are seeking to develop or to acquire
    • Advising on building permits and building licences from local planning and construction committees
    • Interpretation of building permits and licences
    • Acting for clients on appeals to the district and national planning and construction appeal committees in respect of the refusal to issue a building permit or disputed building permit conditions
    • Defending clients in respect of any disputed use of real estate or in enforcement proceedings commenced by any governmental authority
    • Administrative law proceedings before the Israeli Supreme Court seeking to challenge, modify or set aside any decision of a local, district or national planning and building committee

     

    Our clients include property owners, developers, civil engineers, local authorities, construction companies, energy and utility companies.

    • Representing a group of hundreds of private land owners in a real estate project worth $250 million for the planning and construction of over 400 housing units in the largest residential development currently taking place in Tel Aviv - "Kikar Hamedina" - one of the most prestigious districts of the city of Tel Aviv
    • Representing a number of major developers with regard to all matters concerning quarry construction, including the development of industrial zones and obtaining permits for quarrying.  This representation included obtaining a favourable ruling in judicial review proceedings that set aside proposed changes to zoning laws which would have effectively prohibited the use of certain land for quarrying purposes
    • Representing E.S.P.Y. Ltd., an environmental projects company, in administrative and civil law matters relating to Israel’s largest construction waste landfill site, including with regard to permits to operate, zoning and construction
    • Representing Teva Pharmaceuticals in proceedings commenced against the local authority planning and building committee with respect to the committee’s refusal to issue a building permit needed by Teva to build diesel containers at its logistic centre
    • Representing the Weizmann Institute of Science on a number of complex real estate transactions, including acting for the Institute in a combination real estate transaction relating to the planning and construction of the Tamar Science Park (a 25 acre property development) and in the planning of a second residential area for the Institute's scientists
    • Representing Ramat Gan Municipality in proceedings brought against it by land owners, claiming compensation due to zoning changes affecting adjoining land and a decision to build a trail near the land
    • Representing Ramat Gan Local Committee for Planning, before the Supreme Court, in a zoning dispute relating to the construction of a building for a law college
    • Representing the publicly quoted Marshaze Ltd., one of Israel’s largest real-estate developers, and several of its subsidiaries, on all property, planning and zoning matters, concerning the construction of its flagship developments in the Gush Dan region, in which Tel Aviv and other major conurbations are located
    • Representing the municipality of Ramat Gan in connection with all planning issues arising from the proposed construction of the Tel Aviv light rail, including compulsory purchases, zoning matters and in defending petitions filed by affected local residents
