  • The Israeli Supreme Court: Patent rights do not override Patients' rights!

    In a landmark judgment[1] rendered on June 15, 2016, the Supreme Court allowed an appeal filed by The Manufacturers Association of Israel (“the Association”), but denied that filed by Merck Sharp & Dohme Corp. (“MSD”), thereby determining that MSD's patent term extension (“PTE”) for ezetimibe (EZETROL®, marketed in the US under the name ZETIA®), has expired. The judgment has significant importance, both with respect to the constitutionality, as well as to the purposive interpretation of the amendment of the Israeli Patents Law, 1967 back in 2006.

  • AIPPI confirmed Adv. Tal Band’s nomination for the award in view of his unique and continuous activity and contribution to advancing the protection of intellectual property, in Israel and worldwide, and his long and successful involvement in the activity and the management of the association. Tal, who heads the IP practice group at our firm, had been, among many other roles and positions, the President of the Israeli Chapter of AIPPI for a period of 12 years, and also served as the President of the Membership Committee of the international association. The prestigious award, accompanied by a personal medal, was received from Mr. Gérard Myon, Treasurer General of AIPPI, at the beginning of the Third International Convention on the Economy of Innovation which was recently held in Israel. Mr. Myon praised Tal's contribution and many achievements in the IP arena and thanked him, on behalf of the association, for his activity and achievements.
